Theft matter  adjourned to October 25

The theft matter against Sina Daniel was adjourned to October 25 at the High Court call over before Chief Justice Patrick Keane on Friday.

Daniel is charged with one count of theft and four counts of using a document with the intent to defraud.

Defence lawyer Norman George said the defendant used to work at a bank and he needed to go through all the documents.

George said they elected a trial before the three Justices of the Peace and recommended a former Crown Law prosecutor to sit as the third JP to preside in the matter.

However, CJ Keane said he understood his proposal but the Justices of the Peace decide who sits in a particular case and George would need to file a memorandum with the JPs court.

Crown Law’s Catherine Evans said the issue in the case was that they needed to separate the charges that would be presided by the JP hearing and those that would be presided over by the High Court.

She said they could all be presided over in the Judge’s Court.

However, George said they elected a trial by the three JPs.

CJ Keane said he was not challenging George’s right of election for the trial and advised both Crown Law and defence to look over the matter.

In an earlier report, George said the first charge involved a $5000 amount. He also believes there’s another charge for $5000 that needs to be completed.
