Court briefs

September 16

A man, who was disqualified from driving after being sentenced earlier this year, appeared in Court last week, facing four new driving related charges.

Tei John Harawira, who was advised of his rights to a lawyer, appeared before Justice of the Peace Tangi Taoro at the Criminal Court in Avarua on Thursday.

The court heard that on September 7, Harawira drove a motorcycle on a public road in Arorangi. A breath alcohol test was administered, and it returned a result of 670 micrograms.

Earlier last week, police reported that the 46-year-old dangerous, drunk driver, who is a known disqualified driver, faced multiple charges after being pursued by Police. The person sped away and failed to stop until he reached home, where he tried to hide. The person was later identified as Harawira.

Police prosecutor senior sergeant Fairoa Tararo requested a probation report for Harawira.

In February this year, Harawira was convicted of excess blood alcohol for a 2022 driving related charge and was convicted and ordered to pay a fine. He was also disqualified from driving.

On Thursday, he pleaded guilty to a charge of EBA, reckless driving, failing to stop on demand and driving while disqualified.

He will be sentenced on October 22.

In another EBA matter, Poanere Mataiti, who denied the charges of excess breath alcohol and careless driving, will reappear in court for a defendant hearing on November 8.

It is alleged that Mataiti drove a motorcycle at Nikao carelessly and with an alcohol level of 620mcg after being breathalysed.

He is on bail with the condition not to consume or purchase alcohol and not to enter liquor licence premises such as bars and nightclubs.

Teaumetua William Araipu’s case was adjourned to October 31 after police informed the Court of a diversion.

Defence lawyer Norman George informed the Court that both the accused and the partner were subject to a police diversion.

Police prosecutor senior sergeant Fairoa Tararo said a diversion had been approved and asked for an adjournment to give time for the diversion process.

Araipu faces a charge of wounding with intent.

In the case of Marsela Kareroa, defence counsel Michelle Tangimama told the Court that she was still waiting for the video footage from police.

Tangimama asked for an adjournment to November 28.

Police prosecutor senior sergeant Fairoa Tararo told the Court there was a delay in releasing the video evidence because of the length of the footage. Kareroa is charged with three counts of theft.
