Woman convicted of excess alcohol

A woman, who was involved in a crash in March this year, was convicted and ordered to pay a fine of $234 for a charge of excess blood alcohol.

Paioro Te Ariki Puia appeared before Justice of the Peace Tangi Taoro at the Criminal Court in Avarua yesterday.

Puia was represented by defence lawyer Norman George who told the Court that the crash was caused by somebody else, and it was an unfortunate situation.

George said they hoped that police would prosecute the person who caused the crash.

Senior police prosecutor senior sergeant Fairoa Tararo said a car had made a wrong turn in Arorangi on March 12 of this year, causing a crash.

Senior Sergeant Tararo said it was unfortunate that a blood evidential test for alcohol was conducted on Puia, which returned a result of 163 milligrams of alcohol in her blood.

He said it was her first appearance and recommended the mandatory 12-months disqualification from driving.

JP Taoro said the Court noted that this was her first appearance and had taken into consideration her probation report.

However, she said the court also noted that the level of alcohol was quite high.

JP Taoro recommended a starting point for the fine of $350 based on the alcohol level in her blood. Due to her early guilty plea, she received a 33 per cent discount, resulting in a final fine of $234.

She was further disqualified from driving for a period of 12 months and ordered to pay reparation of $150 for the blood report and $50 court cost.
