Teen spared conviction for careless driving fined for cannabis offences

A teen motorist who had an epileptic fit, leading to a crash, has escaped a conviction for careless driving, but picked up convictions for possessing a bong and cannabis.

The 18-year-old appeared before Justice Christine Grice in the High Court at Avarua charged with careless driving, possession of cannabis, and possession of a bong on Friday.

Police said he had entered an early guilty plea, admitting the bong and cannabis was for his own use.

Defence lawyer Mona Ioane said the crash resulted from an epileptic fit, as his client suffered from a mental health problem.

Ioane said he did not want to go into details, as he already made submissions, but said his client had accepted responsibility.

Justice Grice said the careless driving was due to the epileptic fit, and asked if a discharge would be appropriate.

Police were not opposed.

Justice Grice said the drug charges were serious matters.

The court heard on June 3, he was driving and crashed. The defendant told police he had felt dizzy, while medical records confirmed it was epileptic fit.

Police found cannabis and the bong in his vehicle.

He was convicted and fined $500 for possession of cannabis, $200 for possession of a bong, $50 court costs, and discharged without conviction for careless driving.
