Sentencing date  adjourned for man convicted of  assaulting ex-partner

A man facing sentencing for assaulting his ex-partner after a jury found him guilty, has had his date in court adjourned.

Joshua Nga Utanga was scheduled to appear before Judge Justice Dame Judith Potter via audio visual link at the High Court in Avarua on Friday.

He was to be sentenced on two counts of assaulting his ex-partner.

Staff at the court confirmed sentencing had been adjourned to October 13.

Utanga was found guilty by a jury of five men and six women on July 27, who retired about 1pm and returned with a verdict about 6pm, at the High Court in Avarua, following a four-day trial.

Lawyer Norman George defended him but court documents now show he is represented by Tudor Clee for sentencing. 

Justice Potter set a sentencing date for August 11 and ordered a probation report following the verdict.  

The Crown alleged Utanga assaulted his former partner Melarnie Manuela on five separate occasions over two days between July 10 and 11, 2022.

The jury reached a unanimous decision on three charges, two of not guilty, and one of guilty relating to an incident in which Utanga and Manuela got into a tussle in his van, which ended with her sustaining injuries.

On another charge in which Utanga was accused of smacking her across the face with an open palm, the jury returned a majority guilty verdict.

On a charge of kicking Manuela, he was found not guilty through a majority verdict.

The two unanimous not guilty verdicts related to him pulling her out of a bed, and hitting her with a paddle board pump.
